At Simply Essential, we want you to be happy with your purchase. This Returns & Refund Policy explains when you may return your Simply Essential Electric Nail Trimmer and how returns, replacements and refunds are handled.
This policy is intended to comply with applicable South African consumer protection legislation, including the Consumer Protection Act 68 of 2008 ("CPA") and, where applicable, the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
Nothing in this policy limits, excludes or waives any rights you may have under South African law.
1. Change-of-Mind Returns
If you have simply changed your mind about your purchase, Simply Essential may accept a return where permitted by applicable law and subject to the requirements below.
Because the Electric Nail Trimmer is a personal-use and hygiene-related product, we reserve the right to refuse a voluntary change-of-mind return where the product has been opened, used or handled in a manner that makes it unsuitable for resale, to the extent permitted by law.
Where a change-of-mind return is accepted, the product must:

be unused;
-
be in its original condition;
-
include all accessories, attachments, manuals and other components supplied with the product;

be returned in its original packaging where reasonably possible; and
-
not have been damaged, modified or tampered with.
The customer is responsible for the reasonable cost of returning a product for a voluntary change-of-mind return, unless applicable law requires Simply Essential to bear the cost.
A change-of-mind return does not affect any statutory rights you may have in respect of defective, unsafe or incorrectly supplied goods.
2. Online Cooling-Off Rights
Where a purchase qualifies as an electronic transaction under ECTA, you may have a statutory right to cancel the transaction without giving a reason and without penalty within the applicable cooling-off period prescribed by law.
Where this statutory right applies, Simply Essential will process the cancellation and refund in accordance with the requirements of ECTA.
The consumer may be responsible for the direct cost of returning the goods where permitted by law.
Nothing in this policy is intended to restrict a consumer's statutory cooling-off rights.
3. Defective or Faulty Products
Simply Essential stands behind the quality of its products.
If your Electric Nail Trimmer is defective, unsafe, not of good quality, not in good working order, or otherwise fails to meet the requirements applicable under the CPA, you may be entitled to return the product within the applicable statutory period.
Under section 56 of the CPA, goods are subject to an implied warranty of quality. Where the statutory requirements are met, the consumer may return the goods within six months of delivery without penalty and at the supplier's risk and expense.
Depending on the circumstances and the consumer's statutory rights, the available remedy may include:

repair of the product;
-
replacement of the product; or
-
a refund of the price paid.
Where a product is repaired and the same defect or another failure occurs within the period prescribed by law following the repair, further remedies may apply in accordance with the CPA.
4. What Is Not Considered a Product Defect
A product will not necessarily be considered defective merely because it no longer meets your personal preferences or because it has been damaged through improper use.
Subject to your statutory rights, Simply Essential may reject a claim where inspection reasonably establishes that the problem resulted from circumstances such as:

accidental damage;
-
misuse or abuse;
-
use contrary to the supplied instructions;
-
failure to follow the care, charging or operating instructions;
-
use of incompatible charging equipment or accessories;
-
water or liquid damage where the product is not designed for such exposure;
-
excessive force or impact;
-
unauthorised modification or alteration;
-
an attempted repair by the customer or an unauthorised third party;
-
normal wear and tear;
-
cosmetic damage that does not affect functionality;
-
damage caused after delivery through the consumer's actions or negligence; or
-
use of the product for a purpose for which it was not designed.
This section does not limit any rights the consumer may have where the product was already defective or unsafe when supplied.
5. Incorrect, Incomplete or Damaged Deliveries
If you receive:
-
the wrong product;
-
a product with missing components;
-
a product that was visibly damaged during delivery; or
-
a product that materially differs from the product ordered,
please contact us as soon as reasonably possible after delivery.
Please provide your order number and, where possible, photographs or video showing the condition of the package and product.
We may request reasonable information or photographs to assist us in investigating the issue. This does not remove or restrict any rights you have under applicable law.
Where Simply Essential is responsible for an incorrect or defective delivery, we will arrange an appropriate remedy in accordance with applicable law.
6. Hygiene and Used Products
The Electric Nail Trimmer is intended for personal grooming.
For health and hygiene reasons, Simply Essential may refuse a voluntary change-of-mind return where the product has been used or handled in a manner that makes it unsuitable for resale, to the extent permitted by law.
This restriction does not apply to a consumer's statutory rights relating to defective, unsafe or incorrectly supplied goods.
If you believe your product is defective, please contact us even if the product has been opened or used. We will assess the matter in accordance with applicable consumer law.
7. Returns Process

Do not send a product back without first receiving return instructions from Simply Essential.
Unauthorised returns may experience delays in processing.
8. Product Inspection
Where reasonably necessary, Simply Essential may inspect or test a returned product to determine the nature of the issue and whether the return qualifies under this policy or applicable law.
This inspection is intended to establish the condition and cause of the reported issue.
We will not use an inspection requirement to unlawfully delay, avoid or restrict a consumer's rights under applicable South African law.
9. Refunds
Where you are legally entitled to a refund, Simply Essential will process the refund in accordance with the applicable legal requirements.
Unless otherwise required by law, refunds will generally be made using the same payment method used for the original purchase.
Depending on the payment provider and banking institution, it may take additional time for the refunded amount to appear in your account.
Where a refund is required because the goods are defective or otherwise fall within a statutory return right, Simply Essential will not impose an unlawful cancellation, handling or restocking fee.
10. Return Shipping
Where the return is due to a qualifying defective, unsafe or incorrectly supplied product and applicable law requires Simply Essential to bear the return cost, Simply Essential will arrange or reimburse the reasonable return cost as required.
For voluntary change-of-mind returns where Simply Essential is not legally required to cover the return cost, the customer may be responsible for the direct cost of returning the product.
11. Missing Accessories or Components
Where a customer voluntarily returns a product, Simply Essential may require all components supplied with the product to be returned, including, where applicable:

the Electric Nail Trimmer;
-
charging cable;
-
attachments;
-
protective covers;
-
manuals;
-
packaging; and
-
any other included accessories.
Where permitted by law, missing components or damage may affect whether a voluntary return is accepted.
This does not limit statutory remedies for defective or incorrectly supplied goods.
12. Unauthorised Modifications or Repairs
We strongly recommend that customers do not attempt to open, modify or repair the Electric Nail Trimmer themselves.
Where a product has been modified, opened or repaired by the customer or an unauthorised third party, Simply Essential may decline responsibility for failures caused by that modification, repair or interference, to the extent permitted by law.
This does not affect a consumer's rights where the product was independently defective or unsafe and the consumer's statutory rights otherwise apply.
13. Warranty and Statutory Rights
Any additional warranty offered by Simply Essential or a manufacturer is in addition to, and does not replace, the consumer rights provided by South African law.
Nothing in this policy excludes the implied warranty of quality or any other mandatory consumer protection right that cannot lawfully be excluded.
14. Fraudulent or Abusive Return Claims
Simply Essential reserves the right to investigate suspected fraudulent, dishonest or abusive return claims.
Examples may include:

knowingly submitting false information;
-
returning a different product from the one purchased;
-
deliberately damaging a product and claiming that the damage was caused by a manufacturing defect;

submitting repeated dishonest claims; or
-
attempting to obtain a refund while retaining the purchased product.
Where fraud or abuse is reasonably established, Simply Essential may take appropriate action in accordance with applicable law.
Nothing in this section limits a genuine consumer complaint or statutory right.
15. Sale Items and Promotional Products
Products purchased during promotions, discounts or sales remain subject to all applicable statutory consumer rights.
A promotional price does not remove or reduce a consumer's legal rights in respect of defective, unsafe or incorrectly supplied goods.
Any additional voluntary return conditions applicable to a particular promotion will be clearly communicated at the time of purchase.
16. Our Right to Update This Policy
Simply Essential may update this Returns & Refund Policy from time to time to reflect changes to our business, products or applicable law.
The version applicable to your purchase will generally be the version displayed at the time your order was placed, subject to any mandatory changes required by law.
